Note: New DWRF/CWSRF Contract Boilerplate  

New construction contract boilerplate is now available and must be included in all construction contract specifications. The new boilerplate accommodates three distinct program requirements and requires very deliberate actions by the owner and all potential bidders:  

  1. Davis-Bacon Prevailing Federal Wages, Including Labor Standards Provisions: The U.S. Environmental Protection Agency (EPA) fiscal year (FY) 2012 appropriation bill (Public Law 112-74) mandates compliance with Federal prevailing wage requirements for all DWRF and CWSRF loans funded for FY 2012 and each fiscal year thereafter.  The owner must obtain a copy of the appropriate Wage Determination and incorporate it into this section of the boilerplate prior to bid advertisement and is required to conduct prescribed compliance activities during construction. 
  2. Disadvantaged Business Enterprises (DBE): The EPA created the DBE program to increase the participation of small, minority and women owned firms in the procurement process for goods and services as required by rule, 40 CFR Part 33. The DBE regulation requires conscious efforts from owners and prospective contruction contractors. There are substantive changes made by the DBE rule. The changes include certification requirements for minority and women owned businesses, Good Faith Efforts, maintenance of a bidders list, and contract administration requirements. The DBE program also requires information on the participation of minority and women owned businesses be reported to the EPA. 
  3. Debarment/Suspension Certifications: Entities appearing on the Federal Government's Extended Parties List are prohibited from participating in the DWRF/SRF programs and all bidders are required to provide a signed copy of the enclosed certification form.
