Administrative Hearings
A number of regulatory programs administered by the DEQ provide the right to a contested case hearing. Those programs include, but are not limited to, air quality, surface and groundwater resources, solid waste management, inland lakes and streams, wetlands, great lakes submerged lands, shorelands, sand dunes, drinking water, sewerage treatment, oil and gas production, and underground storage tanks. Contested cases are presided over by an Administrative Law Judge (ALJ) from the State Office of Administrative Hearings and Rules. The contested case hearing process is governed by the Administrative Procedures Act (MCL 24.201, et. seq.), and administrative rules (R 324.1, et seq.).

• Docket
The Docket is a list of all cases pending before the Department in the current fiscal year.

• Opinions and Orders
These documents are decisions on motions issued by Administrative Law Judges. These documents are preliminary and procedual Orders usually issued before a formal hearing record is made. Opinions and orders may involve an array of issues including substantive legal issues, evidentiary issues, discovery issues and summary disposition issues.

• Final Determinations and Orders
These documents are final agency decisions issued after a hearing by the Director. An FDO contains two documents; a Proposal for Decision issued by an Administrative Law Judge, and the FDO which accepts, rejects or modifies the Proposal for Decision.

• Proposed Settlements
Proposed settlements of cases involving the Land and Water Management Division can be found here. Other proposed settlements will be listed in the Department Calendar.
