DEQ Resolves Alleged Open Burn Violations with Moyle Construction, Inc.

June 16, 2005

Department of Environmental Quality Director Steven E. Chester announced that on June 10, the DEQ entered into a Stipulation for Entry of a Final Order by Consent (consent order) with Thomas J. Moyle, Jr., d/b/a Moyle Construction, Inc. to resolve alleged air pollution violations for open burning of trees, logs, brush and stumps at a location closer than 1,400 feet from the boundaries of an incorporated city or village limit, which is prohibited under state law. Moyle Construction, Inc. operates a construction firm located in Houghton.

Under the terms of the consent order, Moyle Construction, Inc. is responsible for training its staff and assuring that all burning activities from its construction operations are conducted properly. Moyle Construction is also responsible for paying fines associated with the past violations in the amount of $3,000 to the State of Michigan.
