DEQ Announces Court Ordered Settlement for Asbestos Violations

The Department of Environmental Quality Director Steven E. Chester today announced that Thomas Carter, former president of Global Alloys, Inc., in settlement of violations of an existing administrative Consent Order and allegations of illegal asbestos demolition/renovation work practices, has been ordered by the Ingham County Circuit Court to pay $410,500 for breach of contract and damages; litigation costs in the amount of $120; and reasonable attorney fees in the amount of $11,817.50. Carter is also enjoined from engaging in commercial demolition and/or renovation, specifically as it relates to asbestos abatement activities in Michigan until he has paid all monies ordered, and is in full compliance with all federal and state regulations as they apply to asbestos demolition/renovation activities. Finally, Carter is enjoined from signing and/or submitting on behalf of himself or any other entity a Notification of Intent to renovate/demolish as it relates to asbestos abatement practices.

Mr. Carter was the sole incorporator, actor, and President, directing all matters associated with Global Alloys, Inc., a demolition and renovation business. Carter, under the guise of operating Global Alloys Inc., had previously entered into a Stipulation of Entry of Final Order by Consent (Consent Order) with the DEQ to resolve alleged asbestos demolition/renovation work practice violations that occurred on the premises located at 28355 Michigan Avenue in Inkster. Carter violated the terms of the consent order by failing to pay the settlement amount of $23,000 contained therein. In addition to violating the administrative Consent Order, Carter also failed to comply with asbestos demolition and renovation work practices.
