PERMIT APPLICATION FEES UNDER THE AUTHORITY OF PART 353, SAND DUNE PROTECITON AND MANAGEMENT, LAND AND WATER MANAGEMENT DIVISION.
The Michigan Department of Environmental Quality's Land and Water Management Division establishs the permit application fees under the authority of Part 353, Sand Dune Protection and Management, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. Section 324.35309 (1) of Part 353 states that: "A local unit of government, or the department if the local unit of government does not have an approved zoning ordinance, may establish a permit and inspection fee."
The following fees apply for all permit applications for projects proposed within designated critical dune areas; $150 for decks with a total area of 225 square feet or less; $250 for removal of blow sand to maintain a use, install erosion protection devices up to 100 feet in cumulative length, removal of more than 2 but less than 10 trees not related to a commercial logging activity, decks larger than 255 square feet, and permit modifications; $600 for additions, garages, appurtenant structures, erosion protection devices larger than 100 feet in cumulative length, parking areas not associated with a special-use project, new, replacement, or maintenance of utilities for a single-family home, including a septic system, removal of 10 or more trees not related to a commercial logging activity, expansion of any road or driveway, and demolition or removal of a building; $2,000 for an industrial or commercial use where the area of impact will be no larger than 1/3 acre; $4000 for construction of a road or driveway if it serves a multifamily development of more than 2 homes or to serve a special-use project, an industrial or commercial use where the area of impact will exceed 1/3 acre, a multifamily use of more than 3 acres, a multifamily use of 3 acres or less if the density of use is greater than 4 individual residences per acre, and a project that would damage or destroy features of archaeological or historical significance; $1300 for all other uses not listed including construction of a single‑family home and associated infrastructure, construction of each additional dwelling on one property, and relocation of a home or building and associated infrastructure in a critical dune area. In addition, Special Exception applications under Section 324.35317 will be $2000.
