The Michigan Department of Environmental Quality has received an application for Clean Corporate Citizen (C3) designation from Detroit Edison Trenton Channel Power Plant, Trenton, as provided for under Administrative Rules R324.1507 to R324.1511: Clean Corporate Citizen Program. A decision on the C3 designation approval or disapproval will be made by May 23, 2003. The C3 program provides incentives for improved environmental protection. Regulated establishments that have demonstrated environmental stewardship can receive C3 designation and public recognition for their efforts and are entitled to certain regulatory benefits. ENVIRONMENTAL SCIENCE AND SERVICES DIVISION

Statewide

COMMUNITY POLLUTION PREVENTION GRANTS PROGRAM. A total of $250,000 in funding is available through the Michigan Community Pollution Prevention (P2) Grant Program to enhance voluntary, proactive implementation of P2 in wellhead protection areas in Michigan. Applications for the Community Pollution Prevention Grants Program are being accepted through May 12th by the Michigan Department of Environmental Quality. Funds will only be made available for projects that demonstrate measurable outcomes and behavior changes reflecting an increased participation in the application of P2 programs within wellhead protection areas. Organizations receiving grants must provide a match of at least 25 percent. The maximum grant amount is $100,000 for each project. Administrative Rules Promulgation

 

WATER DIVISION

PART 125, CAMPGROUNDS, SWIMMING AREAS AND SWIMMERS’ ITCH, OF THE PUBLIC HEALTH CODE, 1978 PA 368, AS AMENDED. The Water Division announces the promulgation of new Administrative Rules pursuant to the Public Health Code, 1978 PA 368, as amended, effective March 13, 2003. The rules changes include new definitions, clarification of permit application requirements and permit review criteria, clarification of permit application requirements and criteria for use of fluridone in Michigan lakes, and requirements for submittal of permit amendment requests. The new rules also include the flexibility to issue general permits for a category of activities, a permit-by-rule, which reduces the need for individual permits, and clarification of posting requirements. The operation includes metal charging, melting, pouring, core and mold making, casting shakeout, sand handling, and finishing. The draft permit is intended to simplify and clarify the facility’s applicable requirements and will not result in any air emission changes at the stationary source. PUBLIC HEARING ON PERMIT APPLICATION SUBMITTED BY DETROIT WATER & SEWERAGE DEPARTMENT, DETROIT, MICHIGAN. The Geological and Land Management Division will hold a public hearing at the Fort Gratiot Township Hall, 3720 Keewahdin, Fort Gratiot, Michigan. The hearing will be for Permit Application Number 02-74-0207-P submitted by Detroit Water & Sewerage Department, 400 Monroe, Suite 700, Detroit, Michigan. The applicant proposes to install an outfall pipe into Lake Huron by constructing a cofferdam from the shoreline. The cofferdam will require the placement of 700 cubic yards of fill within Lake Huron. This material will be removed upon installation of the outfall piping. Approximately 2,950 cubic yards of material will be dredged from the lake bottom, of which 1,925 cubic yards of that material will be used as backfill after the pipe installation. The pipe installation will also require approximately 600 cubic yards of fill to be used as bedding material. The purpose of the proposed project is to discharge effluent from a waste wash water treatment facility at the Lake Huron Water Treatment Plant to Lake Huron. PUBLIC HEARING ON PERMIT APPLICATION SUBMITTED BY NORTHWOODS DEVELOPMENT COMPANY, INC., ONEKAMA, MICHIGAN. The Geological and Land Management Division will hold a public hearing at the Village of Onekama, Farr Center, 5283 Main Street, Onekama, Michigan. The hearing will be for Permit Application Number 02‑51‑0016‑P, submitted by Northwoods Development Company, Inc., P.O. Box 596, Onekama, Michigan. The applicant proposes to increase the number of boat slips, remove three seasonal docks and associated hoists, place sand for beach nourishment, and dredge a new marina basin at an existing marina on Portage Lake for the purpose of providing additional boat slips for use by guests of Portage Point Inn, local boat owners, and transient boaters. The U.S. Army Corps of Engineers will also review this application pursuant to their authority under the Rivers and Harbors Act of 1899. The Geological and Land Management Division will hold a public hearing at the Grosse Ile Township Hall, Merle Solomon Board Room, 9601 Groh Road, Grosse Ile, Michigan. The hearing will be for Permit Application Number 02‑82‑0138‑P, submitted by Ford Yacht Club, P.O. Box 204, Grosse Ile, Michigan. The applicant proposes to excavate from wetlands, uplands, and river bottomland, and install a steel sheet pile bulkhead to construct a barge well and operate a proposed barge from the Ford Yacht Club to Round Island on Frenchmen’s Creek for the purpose of transporting pedestrians and equipment. PUBLIC HEARING ON PERMIT APPLICATION SUBMITTED BY WINDHAM DEVELOPMENT, INC., WEST BLOOMFIELD, MICHIGAN. The Geological and Land Management Division will hold a public hearing at the City of Farmington Hills, Council Chambers, 31555 West Wleven Mile Road, Farmington, Michigan. The hearing will be for Permit Application Number 03-63-0039-P, submitted by Windham Development, Inc., 6022 West Maple Road, Suite 415, West Bloomfield, Michigan. The applicant proposes to place fill and excavate; install a retaining wall, water main, stormwater sewer, and outfall discharges within wetlands; and construct an arch span bridge, retention ponds, and wetland mitigation for the purpose of developing 61 detached site condominiums at the corner of 8 Mile Road and I‑275. The proposal requests authority to permanently alter and impact 0.70 acres of wetland and impact 0.18 acres of wetland for three years. Wetland mitigation is proposed. The proposed project is located in the city of Farmington Hills, Oakland County, Michigan. The Geological and Land Management Division will hold a public hearing at the Port Huron Charter Township Hall, 3800 Lapeer Road, Port Huron, Michigan. The hearing will be for Permit Application Number 03-74-0024-P, submitted by St. Clair County, 200 Grand River Avenue, Port Huron, Michigan. The applicant proposes to excavate and place fill within a wetland to accommodate building and pavement construction related to the construction of internal roads, parking, and service areas; placement of storm sewer pipes; and the construction of a detention pond. The applicant also proposes approximately 9.5 acres of wetland mitigation to compensate for the 5.08 acres of wetland to be impacted at the site. All activities are for the proposed construction of a new Sheriff’s Office and Intervention Center. The proposed project is located in Port Huron Township, St. Clair County, Michigan. DEADLINE FOR COMMENTS REGARDING NOTICE OF PROPOSED AMENDMENT TO CONSENT DECREE INVOLVING COPPER RANGE COMPANY, ONTONAGON COUNTY. Comments will be taken through April 25, 2003, on a proposed consent decree amendment concerning the State of Michigan vs. Copper Range Company (Copper Range). A consent decree dated October 27, 1997, required Copper Range to perform a DEQ-approved closure of its former underground solution mine and implement a DEQ-approved remedial action plan (RAP) pursuant to Part 201, Environmental Remediation, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. The proposed modifications to the Decree provide for an alternative financial assurance mechanism and do not modify any obligations of Copper Range to perform response activities. The modified Decree will allow Copper Range to eliminate an existing $3 million letter of credit while requiring a continuation of the financial assurance requirements of an existing corporate guarantee provided by Copper Range's parent corporation, Inmet Mining Company. The modifications also require Copper Range to fund a trust fund for the long-term management of brine contaminated groundwater at the Facility. The financial assurance mechanisms are meant to assure the obligations of Copper Range to implement both the DEQ-approved mine closure and RAP in accordance with law. The C3 program provides incentives for improved environmental protection. 42nd ANNUAL CONFERENCE OF THE MICHIGAN LAKES AND STREAMS ASSOCIATION. The 2003 Michigan Lakes and Streams Association (ML&SA) Annual Conference will be held at Shanty Creek Resort, Summit Village, Bellaire, Michigan. The conference is open to the public and is dedicated to building working relationships between local and state associations through education of citizens on issues that will help protect Michigan’s water. Workshops and concurrent sessions will be held on such topics as Wasting Disease affecting the deer population, invasive plants spreading throughout the state, lead poison in migratory water fowl, road-end legal issues, pollution of surface waters by concentrated animal feeding operations, groundwater uses and regulations, what’s happening to your shoreline, and water safety on your lake. There will also be a training session for the Cooperative Lakes Monitoring Program on Friday, April 25, 2003. Workshop and session instructors include staff from the Michigan Departments of Environmental Quality and Natural Resources, Michigan State University, and the ML&SA’s Science Advisory Committee. The pre-registration costs for all three days are $55 per person for lake association members or $65 per person for nonmembers when pre‑registered by April 18, 2003. AIR AND WASTE MANAGEMENT ASSOCIATION-EAST MICHIGAN  CHAPTER, SPRING CONFERENCE, ST. JOHN'S GOLF AND CONFERENCE CENTER, 44045 FIVE MILE ROAD, PLYMOUTH, MICHIGAN. This full-day conference, "Changes Changes Everywhere," will feature topics focusing on changes in the Administration and the management of the Michigan Department of Environmental Quality (DEQ) as well as numerous rule changes. Expected speakers include Lt. Governor John Cherry, DEQ Director Steven Chester, and various other members of DEQ’s management team. With respect to air programs, the conference will provide important details on recent rule changes impacting industry and the DEQ, including New Source Review Reform and new MACT rules. The conference also includes sessions on spill reporting and emergency planning as well as a "simulated" RCRA inspection at a facility. SARA TITLE III WORKSHOPS. These workshops focus on the reporting requirements in Title III of the Superfund Amendments and Reauthorization Act (“SARA Title III”), also known as the Emergency Planning and Community Right-to-Know Act of 1986. Topics include: reporting requirements with an emphasis on toxic chemical release inventory (TRI) and hazardous chemical release reporting requirements under all federal and state regulations that apply in Michigan. ANNUAL WASTEWATER REPORT (AWR) GUIDANCE WORKSHOPS. The AWR Program and the Critical Materials Register (CMR) are administered by the Michigan Department of Environmental Quality (DEQ). The AWR program was established pursuant to Part 31, Water Resources Protection, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (NREPA), Section 3111. Under this program, the use of materials listed on the Critical Materials Register (CMR) above threshold amounts must be reported. The wastewater report includes the quantities of critical materials used in, and incidental to, manufacturing processes, including by-products and waste products. The AWR workshop is designed for companies who discharge wastewater to the waters of the state or to a sanitary sewer system or who use chemicals listed on the Critical Materials Register (CMR) and discharge them into wastewater or residuals transferred off-site for further treatment.
