Comments will be taken through April 25, 2003, on a proposed consent decree amendment concerning the State of Michigan vs. Copper Range Company (Copper Range). A consent decree dated October 27, 1997, required Copper Range to perform a DEQ-approved closure of its former underground solution mine and implement a DEQ-approved remedial action plan (RAP) pursuant to Part 201, Environmental Remediation, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. The proposed modifications to the Decree provide for an alternative financial assurance mechanism and do not modify any obligations of Copper Range to perform response activities. The modified Decree will allow Copper Range to eliminate an existing $3 million letter of credit while requiring a continuation of the financial assurance requirements of an existing corporate guarantee provided by Copper Range's parent corporation, Inmet Mining Company. The modifications also require Copper Range to fund a trust fund for the long-term management of brine contaminated groundwater at the facility. The financial assurance mechanisms are meant to assure the obligations of Copper Range to implement both the DEQ-approved mine closure and RAP in accordance with law. Any comments should be sent to James L. Stropkai, Assistant Attorney General, on or before 5:00 p.m., April 25, 2003.
