    Boiler - NESHAP Area Sources

     

    Boiler Area Source NESHAP

     

    The National Emission Standards for Hazardous Air Pollutants (NESHAP) for new and existing area source boilers (40 CFR Part 63 Subpart JJJJJJ) were published in the Federal Register on March 21, 2011 and became effective May 20, 2011.

     

    The final rule covers boilers located at area source facilities that burn coal, oil, or biomass, or non-waste materials, but not boilers that burn only gaseous fuels or any solid waste. Area sources are commercial (laundries, apartments, hotels), institutional (schools, churches, medical centers, municipal buildings) or industrial (manufacturing, refining, processing, mining) facilities that emit or have the potential to emit less than 10 tons per year of a single hazardous air pollutant, or less than 25 tons per year of combined hazardous air pollutants.

    Notification Forms and Information

     

    When must I submit an Initial Notification (§63.9(b)(2))?

     

    Existing sources:  No later than September 17, 2011.

     

    New sources:  No later than September 17, 2011, or within 120 days after startup of a new source, whichever is later.

    When is this report due (§63.11225(a)(4))?  

     

    Existing Sources:  The Notification of Compliance Status must be submitted no later than July 19, 2012.

     

    New Sources:  The Notification of Compliance Status must be submitted by no later than September 17, 2011 or 120 days after startup, whichever is later.

     

    When is this report due (§63.11225(a)(4))?  

     

    Existing Sources:  For boilers subject to emission limits, the Notification of Compliance Status must be submitted within 60 days after completing the performance stack test.  The performance stack test must be completed no later than September 17, 2014. 

     

    New Sources:  For boilers subject to emission limits, the Notification of Compliance Status must be submitted within 60 days of completing the performance stack test.  The performance stack test must be conducted within 180 days of startup. 

     

    When is this report due (§63.11225(a)(4))?  

     

    Existing Sources:  For boilers subject to an energy assessment the Notification of Compliance Status must be submitted by July 19, 2014.

     

    New Sources:  New sources are not subject to this reporting requirement.
