The table identifies the escalated enforcement actions for the Remediation Division in which there is an on-going civil litigation or the action has been resolved through execution of legally enforceable settlement agreement, court order, or order of the Director of the Department of Environmental Quality (DEQ). The regulatory authority under which the enforcement actions are taken include, but are not limited to, Part 201, Environmental Remediation; Part 213, Leaking Underground Storage Tanks; Part 215, Refined Petroleum Fund of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended and/or the Comprehensive Environmental Response, Compensation and Liability Act, 42 USC 9601 et seq., as amended.
The table also provides a link to the relevant legally enforceable settlement agreements associated with the enforcement actions. If the enforcement action is being undertaken through civil (i.e., court) procedures, links are provided to the complaint and relevant court decisions.
To assist in review of the tables, the enforcement actions have been associated with a Part 201 site (Site) or Part 213 facility (Facility) when applicable. A site or facility may be associated with multiple number and types of enforcement actions. Also, enforcement actions may be associated with multiple Sites or Facilities and are designated as "multiple" in the table column denoted as County. If the enforcement action pertains to a bankruptcy or QC/CP revocation, the action has been associated with the legal entity subject to the action.
The information provided through the links is routinely updated and include enforcement actions that have been initiated or resolved on or after January 1, 2004. Enforcement actions that were initiated in the table as the result of some action (e.g., modification of the settlement) occurred after January 1, 2004.
