Safe Delivery of Newborns Law

SB 1187  (1999-2000), Public Act 234 of 2000 - Exempts the surrender of a newborn, who is not a victim of child abuse, from the provisions of the Child Protection Services law.

SB 1052  (1999-2000), Public Act 232 of 2000 - Defines an emergency service provider (ESP), outlines the responsibilities of an ESP, court, private agency and certain state agencies.

SB 1053  (1999-2000), Public Act 233 of 2000 - Amends the penal code to allow for an affirmative defense against child abandonment charges for a surrendering parent. A criminal investigation will not be initiated solely on the basis of a newborn being surrendered to an ESP.

HB 5543  (1999-2000), Public Act 235 of 2000 - Requires the development of an informational pamphlet and a toll-free 24 hour telephone line by the Department of Community Health and Department of Human Services (formerly known as the Family Independence Agency.)

SB 1292  (2005-2006), Public Act 488 of 2006 - Expands the definition of an emergency service provider and changes and/or clarifies the roles of the court and the child placing agency.
