FINAL DECISION

The Administrative Law Judge issued a Proposal for Decision dated May 30, 2003. She recommended that the Commissioner affirm the denial of licensure. Neither party filed exceptions.

The factual findings in the PFD are in accordance with the preponderance of the evidence and the conclusions of law are supported by reasoned opinion. The PFD is attached, adopted, and made part of this final decision. However, in adopting the PFD, two problems are noted. The first sentence on page 3 of the PFD begins: "The issue presented is whether Petitioner qualifies for relicensure of her revoked resident insurance producers/agent's license under Section 1205 of the Code, . . ." This suggests a reinstatement of her previous license. However, upon final revocation, a license ceases to exist. Thus, the sentence is recast as follows: "The issue presented is whether Petitioner qualifies for licensure under Section 1205 of the Code, . . ."

Similarly, in the Proposed Decision section on page 15, the second sentence reads: "It is further proposed that the Commissioner affirm the denial of Petitioner's September 24, 2002, application for licensure of her revoked resident insurance agent license at this time." An appropriate order is stated below.

Therefore, it is ORDERED that the refusal to issue an insurance producer's license to the Petitioner is affirmed.
