OCTOBER 24, 2000 - The Michigan Department of Consumer & Industry Services (CIS) Bureau of Regulatory Services has issued a summary suspension order and an intent to revoke action to Paula Durek, of 4850 Grand St, Muskegon. Ms. Durek has been ordered to immediately cease providing care to children effective 6:00 P.M. today. These actions are the result of a recent complaint investigation of her family day care home.

Under Michigan statute, a Family Day Care Home is defined as "a private home in which 1 but fewer than 7 minor children are received for care and supervision for periods of less than 24 hours a day, unattended by a parent or legal guardian, except children related to an adult member of the family by blood, marriage, or adoption. Family day care home includes a home that gives care to an unrelated minor child for more than 4 weeks during a calendar year."

The October 23, 2000 findings of the complaint investigation determined that a 6 ½ month old infant was taken by ambulance from the Durek day care home on October 18, 2000 to a local hospital, then to be transported to a Grand Rapids hospital. There the infant was diagnosed with head injuries consistent with shaken baby/shaken infant impact syndrome. It was further found that Ms. Durek, upon finding the infant unconscious, failed to act promptly in seeking emergency medical assistance.

Effective 6:00 P.M. on Tuesday, October 24, 2000, the Summary Suspension order requires the registrant not to operate a family day care home at 4850 Grand St., Muskegon, Michigan or at any other address or location. Children are not to be received for care after that date or time. The order also requires Ms Durek to inform all of the parents or guardians of children in care that her registration has been suspended and that she can no longer provide child care.

An administrative hearing regarding the Department’s suspension and revocation action will be scheduled.

Paula Durek has held a registration for a day care home since March, 1998. Her family day care home registration was for 6 children, aged birth through 17 years.
