NOVEMBER 08, 2002 - Michigan Department of Consumer & Industry Services (CIS), Bureau of Regulatory Services has issued an order of summary suspension and notice of intent to revoke action to Ingham family day care home licensee, Cynthia Kindel, 4446 Stonehurst, Holt, Michigan. Cynthia Kindel has been ordered to immediately cease providing to children effective 5:00 p.m., Friday, November 8, 2002. These actions are the result of a recent complaint investigation of the family day care home.
Under Michigan statute, a family day care home is defined as “a private home in which 1 but fewer than 7 minor children are given care and supervision for periods of less than 24 hours a day unattended by a parent or legal guardian, except children related to an adult member of the group by blood, marriage, or adoption. A family day care home includes a home that gives care to an unrelated minor child for more than 4 weeks during a calendar year.”
The November 8, 2002, findings of the complaint investigation found that:
· On November 5, 2002, Ms. Kindel struck an eight-month-old child care child on the face, twice, causing a bruise and a red mark.
· Ms. Kindel initially claimed that a toddler fell on the child with a toy in his hand, causing the injuries.
· When confronted by the police, she admitted to stricking the child twice on the cheek.
· Ms. Kindel also admitted this conduct to the Bureau's Licensing Consultant.
Effective 5:00 p.m., Friday, November 8, 2002 the Summary Suspension Order requires Cynthia Kindel not to operate a family day care home at 4446 Stonehurst, Holt, Michigan. Children are not to be received for care after that date or time. The order also requires Cynthia Kindel to inform all of the parents or guardians of children in care that the license has been suspended and child care can not longer be provided.
An Administrative Hearing regarding the Department’s suspension and revocation action will be scheduled. Cynthia Kindel has held a certificate of registration to operate a family day care home since December 4, 1992. The license was for 1-6 children.
