These are technical bills. Although not all of the bills are tie-barred to it, they are related to House Bill 5228, which adopts the revised Uniform Commercial Code, Article 9. The bills strike out references to the Uniform Commercial Code and replace them with new section number references in the revised code and the latest Legislative Service Bureau statutory citation format. House Bill 5411 deletes a reference to a repealed article of the Uniform Commercial Code. The bills amended are as follows:
Vietnam Veteran Era Bonus Act
The Revenue Bond Act of 1933
Uniform Federal Lien Registration Act*
State Tax Lien Registration Act*
Michigan Vehicle Code
Public Act 387 of 1978 (loans to motor carriers)*
Grain Dealers Act *
Higher Education Facilities Authority Act
Farm and Utility Equipment Act
Business Corporation Act
Nonprofit Corporation Act
Savings and Loan Act of 1980
Motor Vehicle Sales Finance Act*
Uniform Fraudulent Transfer Act*
*Tie-barred to House Bill 5228 with a July 1, 2001 effective date
Two bills that were part of the originally introduced package have not been enrolled. These are House Bill 5410 (college and university powers) and House Bill 5414 (Savings Bank Act). The first of these was not consequential. The bill merely made technical changes in Public Act 289 of 1976. However, House Bill 5414 corrected a defect in the Savings Bank Act arising from repeal of Section 9404 of Article 9 by House Bill 5228.
Two technical problems were noted in the package. House Bills 5407, 5408, and 5417 make reference to Article 9 of the Uniform Commercial Code, but the Michigan Compiled Laws citation is not complete. The Legislature added Section 9709 to the bill after introduction and the section references in these bills were not subsequently corrected.
