This bill mandates that the department establish a 24 hour electronic database and a toll free phone line to dispense pertinent information about a licensee to the public. This information includes any final disciplinary action taken against a licensee and any final administrative disciplinary action taken against the licensee by regulatory agencies of other states, countries, federal governments or the US military. An individual's criminal convictions since being licensed are also required to be posted on these sites.
Final malpractice decisions against the licensee must also be posted, although pending claims are not to be shared with the public. In addition, when reporting malpractice settlements, the department must include a statement indicating that settlements may occur for a variety of reasons, and that a settlement is not necessarily indicative of negative professional competence. Payment of a claim should not be construed as a signal that malpractice has actually occurred.
Other information that should be made available to the public include:
• any loss of hospital privileges.
• updates on licensure and registration revocation, suspensions, reprimands, fines, restitutions and probations within the last 10 yrs.
• names of medical or other health professional schools and dates of graduation.
• specialty certification.
• number of years in practice.
• hospitals where the licensee is permitted to practice.
• appointment to a medical/professional school faculty.
• information about publication in peer-reviewed medical or other health professional literature within the past 10 yrs.
• community service activities or professional awards.
• the location of the licensee's primary practice.
• the identification of any translating services that may be available at the licensee's primary practice location.
• an indication of whether the licensee participates in medicare.
