MPSC Directs The Detroit Edison Company to File Tariffs that It Intends to Implement in Electric Rate Case

Contact:  Judy Palnau (517) 241-3323

May 26, 2009

The Michigan Public Service Commission (MPSC) today directed The Detroit Edison Company to file by noon on June 26 tariffs (rates) that it proposes to self-implement between July 26 and January 26, 2010.

Under Public Act 286 of 2008 (PA 286), a utility may implement a rate increase - up to the amount it has requested - 180 days after the filing of its complete application, if the MPSC has not yet issued an order in the case.  That date is July 26 in Case No. U-15768, Detroit Edison's pending electric rate case.

All parties to the case will be able to respond to the utility's proposed tariffs, if they so choose, in responses to be filed no later than July 9.

In addition, the MPSC directs the administrative law judge in the case to conduct a hearing at 9 a.m. on July 10.  At that hearing, Detroit Edison is directed to provide one witness to support the justness and reasonableness of the proposed tariffs and shall provide evidence regarding the effect of the statutory rate design option and reasonable alternatives thereto.

The MPSC is an agency within the Department of Energy, Labor & Economic Growth.

Case No. U-15768
