FINAL DECISION
The Administrative Law Judge issued a Proposal for Decision dated October
23, 2003. He recommended that the Commissioner enter a default order and
an order of prohibition. No party filed exceptions.
The factual findings in the PFD are in accordance with the preponderance
of the evidence as established by the default of the Respondents and the
conclusions of law are supported by reasoned opinion. The PFD is attached,
adopted, and made part of this Final Decision.
The allegations set forth in the Notice of Intent to Issue Order of
Prohibition Pursuant to MCL 445.1668(a) are incorporated by reference
into the Findings of Fact in this Final Decision. Based upon the fraud
of the Respondents, an additional Conclusion of Law is that the Commissioner
is authorized under MCL 445.668a(3) to issue an order of prohibition.
This is in addition to the authority under MCL 445.668a(2), which arose
because the Respondents did not appear at the hearing.

ORDER
Therefore, it is ORDERED that:
Disposition is made of this contested case by default.
Respondent Kalil Khalil is prohibited from being employed by, an agent
of, or control person of any licensee or registrant under the MBLSLA
or a licensee or registrant under a financial licensing act.
Respondent Tariq Hamad is prohibited from being employed by, an agent
of, or control person of any licensee or registrant under the MBLSLA
or a licensee or registrant under a financial licensing act.
