CIS Summarily Suspends the Group Day Care Home License of Loxi Ryckman of North Branch; Investigation Uncovered Serious Risk to children at the Facility

NOVEMBER 03, 2000 - The Michigan Department of Consumer & Industry Services (CIS) Bureau of Regulatory Services has issued to Lapeer County Group Day Care Home Licensee, Loxi Ryckman, of 6646 Brush St., North Branch, a summary suspension order and an intent to revoke action ordering Mrs. Ryckman to immediately cease providing care to children effective 6:00 P.M. on Friday, November 3, 2000. These actions are the result of a recent complaint investigation of the facility.

 

Under Michigan statute, a Group Day Care Home is defined as "a private home in which more than 6 but not more than 12 minor children are given care and supervision for periods of less than 24 hour a day unattended by a parent or legal guardian, except children related to an adult member of the family by blood, marriage, or adoption. Group day care home includes a home that gives care to an unrelated minor child for more than 4 weeks during a calendar year."

 

The November 3, 2000 findings of the ongoing complaint investigation found that:

 

· Ms. Ryckman’s adult son who has been residing on the premises of the Brush St. day care home had been charged with two counts of the delivery of child pornography.

· Ms. Ryckman’s son has had opportunity to interact with day care children.

· The telephone number used in the Internet delivery of the child pornography originated from 6646 Brush St. premises.

 

The Summary Suspension order requires the licensee not to operate a group day care home at 6646 Brush St., North Branch, Michigan or at any other address or location effective as of 6:00 P.M., November 3, 2000. Children are not to be received for care after that date or time. The order also requires Mrs. Ryckman to inform all of the parents or guardians of children in care that her license has been suspended and that she can no longer provide child care.

 

An Administrative Hearing regarding the Department’s suspension and revocation action will be scheduled.

 

Loxi Ryckman has held a license/registration for a day care home since May of 1978. Her recent group day care home license for 12 children, aged birth to 17 years, was issued on October 29,1999.
