Senate Bill 381

Senate Bill 381 would amend section 10204 of the Public Health Code to place restrictions on where and by whom an organ transplant, implementation, infusion, or injection can be performed. This bill would ensure that only physicians and directed employees of an organ procurement organization or tissue bank could perform such operations. An individual could perform a transplant if they were acting under the authority and supervision of a physician, unless the individual had their license suspended or revoked.

In regards to the transplantation of human eyes, the only individuals allowed to perform such operations are designated employees of federally registered eye banks and individuals licensed by a state medical school under section 10105 of this act.

Any of the above mentioned operations must be performed in a hospital licensed under article 17 or in another facility approved by the director of the Department of Community Health.

An individual in violation of any of these sections is guilty of a felony.
