ATTENTION: On January 4, 2012, the State Construction Code Commission approved a moratorium until July 9, 2012, on the establishment of new construction code enforcing agencies until the Governor's Office of Regulatory Reinvention's Inspection and Permitting Advisory Rules Committee completes its assignment to review and recommend improvements for permitting and inspection activities throughout the state. As a result, at this time, the Bureau of Construction Codes is unable to process Applications to Administer and Enforce that would establish completely new enforcing agencies.
This moratorium does not affect governmental subdivisions that already enforce one or more of the construction codes and wish to submit an application for enforcement authority of additional codes.
An application for approval to administer and enforcemust be completed when a unit of government is seeking approval to locally enforce the construction codes. The application must be completed in its entirety and all requested information must accompany the application. Applications must be received by the Bureau of Construction Codes no later than 45 days prior to the next scheduled commission meetingto allow for adequate review time. Failure to allow the requested review time will result in a recommendation to the State Construction Codes Commission for denial of the application.
Applications that are submitted timely will be reviewed by staff within the bureau's Office of Administrative Services and a recommendation for approval or denial will be made to the Commission. Public Act 230 of 1972, Section 8b (6) requires that "The commission shall render a decision on the application for approval to administer and enforce this act and the code and transmit its findings to the governmental subdivision within 90 days of receipt of the application."
A unit of government may not begin enforcing the code until the Commission has approved the application to administer and enforce. An enforcement start date will be determined by the bureau based on the Commission's approval and the appropriate notification period.
