House Bill 4834 amends the Housing Law of Michigan. An existing dwelling in an area covered by the act must apply with the applicable portions of the Property Maintenance Code adopted by the State Construction Code Commission. The act and the Property Maintenance Code apply throughout the state. (This provision may be inconsistent with Section 1 of the act.) A local governmental unit may supplement certain parts of the Property Maintenance Code by adopting and enforcing local standards. A local governmental unit would do this by ordinance. Such ordinances would be required to be updated at least once every three years.
Much of this content of the current law would be repealed. The subject matter is contained in the Property Maintenance Code.
House Bill 483 5 requires the State Construction Code Commission to adopt whatever portions of the 1998 International Property Maintenance Code it determines to be appropriate. The Commission may update the Code as changes in the international code or other industry promulgated property maintenance codes occur.
A local governmental unit may not exempt itself from the Commission's review of a Property Maintenance Code decision rendered by the local board of appeals. A local governmental unit may not enforce less stringent property maintenance standards than those adopted by the Commission.
The Director of the Department of Consumer and Industry Services is required to appoint an advisory committee to advise the Commission on Property Maintenance Code matters. The advisory committee would consist of seven members, including a sanitarian, rental property owners of 4 or fewer units and 5 or more units, 2 tenant representatives, and a housing inspector from a township and a city.
