Pursuant to and under the authority of the Michigan Weights and Measures Law Public Act 283, of 1964 as amended: all products bought or sold by weight, measure or count, and the devices utilized for those transactions, are the responsibility of the Weights and Measures Program. Included in these responsibilities are the legal method of sale, specifications, tolerances and other user requirements for the device, and device user. This advisory is intended to notify municipalities that purchase calcium chloride solutions or services for the control of dust and or ice on local roadways and other areas traveled, of the legal requirements to ensure the accurate delivery of these products.

All suppliers of calcium chloride solutions must follow the rules cited below:

1. Contracts involving an application service may be billed by a flat rate.
2. Contracts or services whereby charges are determined by a weight or volume of products transported or used must be conducted with an approved commercial weighing or measuring device.
   1. Any scale or meter utilized must have a current certificate of conformance from the National Type Evaluation Program.
   2. Must be installed in a manner consistent with manufacturer requirements and other user requirements to ensure accurate delivery.
   3. Shall be inspected and tested by either a Weights and Measures Official or a Michigan Registered Service Agency that as submitted a properly place in service report to the Office of Weights and Measures, prior to commercial use.

Failure to comply with any of the requirements of the Weights and Measures Law may render the device non-compliant, the measurement inaccurate, and/or nullify the legality of the transaction.

The Weights and Measures Program has reached out to industry members to provide critical information and are currently investigating multiple consumer complaints involving both the method of sale employed, and/or the accuracy of measurement.
