Once the DSC takes action, is their decision final?

Under Michigan law, only a disciplinary subcommittee has the authority to sanction a licensee or registrant. The Public Health Code provides the DSC with specific sanctions to impose based on the violation(s) found.

 

If a licensee or registrant believes that the sanction imposed was excessive or otherwise wishes to contest their sanction, they can file a Request for Reconsideration, asking that the DSC reconsider their sanction(s). The DSC can either grant or deny their request. If granted, the DSC will modify their order.

 

If the DSC decides to deny this request, the order will remain as originally entered and the licensee/registrant is bound to comply with that order. If the licensee or registrant is denied at this juncture, their only recourse is to file an appeal to the Court of Appeals.
