Office of Legal Affairs and FOIA
The Office of Legal Affairs and FOIA (OLAF) is responsible for the legal direction and outcomes of the Department of Community Health. Our customers include department leadership, staff, and the general public. The Office strives to provide competent legal assistance within the mandate of the Michigan Constitution and applicable state and federal law.
The functions of the OLAF are described below:
- Ensuring compliance with the Freedom of Information Act (FOIA);
- Overseeing and coordinating rulemaking in accordance with the Administrative Procedures Act;
- Directing and managing compliance with HIPAA Privacy Regulations;-
- Responding to subpoenas served on the department or its employees;
- Coordinating the department's litigation with the Department of Attorney General;
- Assisting the department's staff in carrying out responsibilities in accordance with applicable laws;
- Providing relevant and useful advice and interpretation to department program staff on complicated legal issues; promoting risk management.
- Ensuring that the department's programs and services comply with Title, II of the Americans with Disabilities Act and Section 504 requirements.

Michigan Freedom of Information Act (FOIA)
The Michigan Freedom of Information Act (FOIA) provides all persons except those incarcerated in correctional facilities with access to public records. Requests to inspect or receive the Department of Community Health (DCH) records must be in writing, and must describe the requested records with enough detail that DCH can identify them.
