The Michigan Department of Community Health (MDCH) has summarily suspended the licensed practical nurse license of Judy Genece Payne, L.P.N., based on her felony conviction in the 22nd Judicial Circuit Court of Washtenaw County, Michigan. Payne failed to report her conviction to MDCH as required by the Public Health Code.
On October 3, 1997, Payne was convicted of Retail Fraud-First Degree, a felony. As a result, Payne was sentenced to 17 days in jail with credit for 17 days, placed on probation with terms for a period of 18 months, and ordered to pay fines and costs totaling $1,540.
On September 23, 2005, MDCH issued an order immediately suspending Payne’s license pursuant to the Public Health Code, which provides for the mandatory summary suspension of a health professional’s license upon the conviction of a felony or a misdemeanor punishable by imprisonment for a maximum term of two years or a misdemeanor involving the illegal delivery, possession, or use of a controlled substance. An administrative hearing will be scheduled to address the status of Payne’s licensed practical nurse license.
