The Michigan Department of Community Health (MDCH) has summarily suspended the licensed practical nurse license of Shirley Ann Wallace, L.P.N., based on her felony convictions in the 6th Judicial Circuit Court, Oakland County, Michigan
On February 1, 1988, Wallace was convicted of one felony count of Uttering and Publishing. On February 9, 2005, Wallace was convicted on two separate cases of Uttering and Publishing, of one felony count for each case. Wallace’s sentence was based on her prior conviction for the same offense in 1988. As a result, Wallace was sentenced as a Habitual Offender-Second Offense Notice, with her sentences to run concurrent for both cases. Wallace was sentenced to 183 days incarceration, with credit for 36 days served, placed on probation for two years with terms, and ordered to pay fines, costs, restitution and fees in the amount of $2,335.21.
On October 3, 2005, MDCH issued an order immediately suspending Wallace’s license pursuant to the Public Health Code, which provides for the mandatory summary suspension of a health professional’s license upon the conviction of a felony or a misdemeanor punishable by imprisonment for a maximum term of two years or a misdemeanor involving the illegal delivery, possession or use of a controlled substance. An administrative hearing will be scheduled to address the status of Wallace’s licensed practical nurse license.
