SUBJECT: PROPOSED RULE AMENDMENTS

On May 24, 2007, Governor Granholm issued Executive Order 2007-30 (EO), effective August 26, 2007. If, at its next meeting, the Civil Service Commission adopts a resolution approving the transfers set out in the EO, the Commission's Rules must be substantially revised. In anticipation of the meeting, staff has prepared the attached draft amendments to the Commission Rules to implement the EO. The amendments address the following:

1. The EO abolishes the Department of Civil Service. The draft amendments delete all references to the Department of Civil Service. In most instances, the amendments simply replace "Department of Civil Service" with "Civil Service Commission."

2. The EO moves the Civil Service Commission as an autonomous entity into the Department of Management and Budget. The draft amendments address the new organizational placement of the Commission.

3. The EO transfers to the Commission the administration of all executive branch human resources operations and staff currently located in the executive departments. These transfers require rule amendments to clarify the respective roles of the appointing authorities and the new Commission staff after the transfers.

4. Unrelated to the EO, staff has also proposed additional minor amendments in Rules 2 14.4, 4-6.2(c), 4-7.2(c), 5-7.1(b)(1), and 9-1 (Definition of "Uniformed Services"). See the draft amendments for explanatory staff comments.

The Civil Service Commission will consider the proposed amendments at its next meeting, scheduled for 10:00 a.m., Tuesday, August 21, 2007, Capitol Commons Center, 400 S. Pine Street, Lansing.
