CIVIL SERVICE REGULATIONS |
The Civil Service regulations have been revised to reflect recent changes to the Civil
Service rules. References to "the Department of Civil Service" have simply been
replaced with "Civil Service" or "Civil Service Commission" as appropriate and, in most
cases, "department(s)", when used in reference to state agencies, has been replaced
with "agency or agencies". Other minor changes have been made for clarification
purposes or to reflect practices that have been in place but not specifically noted.
Additional changes have also been made to certain regulations as discussed below:
Regulation 2.02, Agency Layoff Plans, reflects a minor change in the title (Agency
replaces Department.)
Regulation 2.03, Leaves of Absence, was circulated for review and comment under
SPDOC 07-02. This regulation is currently being finalized and will be issued in the near
future.
Regulation 3.10, Promotion or Lateral Job Change Within An Agency Of Current
Employees Under Hiring Restriction Conditions, reflects a minor change in the title
(Agency replaces Department.) Also, Standard C was a temporary provision that
expired September 30, 2003. Therefore, this standard and Procedure C have been
deleted as they are no longer applicable.
Regulations 4.01, Position Classification Actions That Require Civil Service Review,
and 4.02, Preauthorized Position Classification Actions, were circulated for review and
comment under SPDOC No. 07-07, dated June 15, 2007. Based upon comments
received, additional minor revisions have been incorporated into these regulations.
Significant changes to regulation 4.01 include: (1) new clarifying language under
Standard C regarding the requirements for reclassification and delay of a
reclassification if an incumbent is on extended paid absence of more than two
consecutive pay periods; (2) a new Standard D to address position conversion; and (3)
a new Standard E incorporating Departmental Trainee language, as currently found in
regulation 4.03. In addition, current Standard C.3 language has been deleted.
Significant changes to regulation 4.02 include: (1) defining preauthorized classification
establishment and preauthorized reclassification actions; (2) reorganizing the regulation;
(3) substituting "grade level" with "classification level" given that "grade" is defined as
"classification level" in the Civil Service rule definitions; (3) clarifying language under
Standard B regarding delay of a reclassification if an incumbent is on extended paid
absence of more than two consecutive pay periods; and (4) a new procedure covering
preauthorized establishments.
Regulation 4.03, Establishing and Reclassifying Positions in the State Transitional and
Departmental Trainee Classifications, was also circulated under SPDOC No. 07-07,
dated June 15, 2007. As a result of incorporating Departmental Trainee language from
this regulation into regulation 4.01 and with State Transitional language having been
previously incorporated into regulation 3.14, Transitional Position Designation and
Appointments, this regulation has been determined to be obsolete. Therefore, this
regulation, as titled in this paragraph, has been abolished effective October 7,
2007.
Regulation 4.06, Agency Organizational Charts, has been determined to be obsolete
as the practice of agencies submitting organizational charts to Civil Service each
October 1 is no longer required due to technology processes. Other pertinent language
has been incorporated into regulation 4.07. Therefore, this regulation, as titled in
this paragraph, has been abolished effective October 7, 2007.
Regulation 4.07, Agency Reorganizations and Position Recoding, incorporates
language from regulation 4.06 relative to organizational charts in the event of
reorganization.
Regulation 4.09, Employee Generated Position Reviews, has been renumbered to
4.03.
Regulation 4.10, Frozen Classifications And Positions, has been renumbered to 4.06.
Regulation 5.07, Performance-Pay Programs, was issued under SPDOC 07-13, dated
October 1, 2007. This regulation was revised to reflect changes regarding fiscal year
(FY) 07-08, prohibiting performance-pay increases through September 30, 2008. The
October 1, 2007 effective date remains unchanged.
Regulation 5.08, Paid Holidays, includes clarifying language in Standard C.2.b(2) to
reflect current practices regarding employees returning from layoff or leave with regard
to holiday credit.
Regulation 5.09, Annual, Personal, and School and Community Participation Leave,
reflects clarifying language in Standard B with regard to personal leave credit.
Regulation 5.20, Correcting Benefit Errors, has been renumbered to 5.19.
In accordance with Standard C of Regulation 1.01, Issuance of Civil Service
Regulations, the attached regulations are being issued with an effective date of
October 7, 2007.
