Federal safety rule applies to the media when "working" on Michigan roads

March 15, 2010 -- The Michigan Department of Transportation (MDOT) today issued an important safety reminder to all members of the media about the 2006 Federal Highway Administration's (FHWA) Worker Visibility Final Rule which requires high-visibility safety vests be worn when working within the right of way (ROW) of a federal-aid highway. This rule also applies to MDOT property or ROW.
FHWA 23 CFR Part 634 states: "All workers within the ROW of a federal-aid highway, who are exposed either to traffic (vehicles using the highway for purposes of travel) or to construction equipment within the work area, shall wear high-visibility safety apparel."
Furthermore, the rule states that "high-visibility apparel" should meet the American National Standards Institute and Safety Equipment Association (ANSI/SEA) 107-2004 performance Class 2 or 3. "Workers" are defined as people whose duties place them within the ROW of a federal-aid highway, including members of the media.
