Licensure Determination


Use this flowchart to assist in the determination of your appropriate level of licensure and the applicable applications which need to be submitted.



Are you a person or entity that supplies or provides gaming related goods or services to a casino licensee or supplier licensee which are directly related to gambling, related to the conduct of gambling activity, or directly affect the play and results of gambling games authorized, conducted, and played according to the Act and Rules?  Right arrow saying Yes

Complete "Gaming Supplier License Application" and submit to the MGCB with all required disclosures.

Down Arrow saying No 

 

Are you an agency of state, local, or federal government?

 Right arrow saying Yes

Resolution 2009-01 automatically grants an exemption. MGCB does not require the submission of an application.

Are you regulated by another regulatory agency in Michigan or a federal agency?  Right arrow saying Yes

Complete a "Supplier License Exemption Application" and submit to the MGCB.

Are you one of the following:
1.  Publicly-traded US Corporation under Securities Exchange Commission, or a wholly-owned subsidiary of such a corporation.
2.  Person who provides facilities, promotion or advertising and is one of the following:
a.  Media Outlet (newspaper, magazine, outdoor advertising business, radio or television) that
   i.  Derives less than 5% of annual overall gross revenue from advertising by casino licensees; and,
   ii.  Provides documentation of overall gross revenues and the gross revenues derived from doing business with casino licensee on a semi-annual basis
b.  Provider of a facility or host or sponsor of an event that presents advertising on behalf of or promotes a casino licensee, including but not limited to theatres, ballrooms, halls, arenas, parks, stadia, golf courses, and other entertainment, recreational, and sports facilities locating in Michigan
c.  Provider of a facility that provides entertainment, recreational, or hospitality services and is a theatre, ballroom, hall arena, park, stadium, golf course, or special-event venue located in Michigan.

Complete a "Supplier License Exemption Application" & "Semi-Annual Computation Worksheet" and submit to the MGCB.

NOTE:  An exemption granted based on the type of good or service provided permits the exempt person to provide only the goods or services encompassed by that exemption.

Are you one of the following:
1.  A medical corporation, partnership, sole proprietorship, or other business entity authorized to transact business in Michigan, to the extent that the applicant provides medical-related services to a casino licensee.
2.  An insurance company licensed or authorized to transact business in Michigan by the Michigan Office of Financial and Insurance Services to the extent that it provides insurance-related services to a casino licensee.
3.  Professional entertainer, sports figure, celebrity engaged to appear at a casino-sponsored special entertainment or promotional event, or agent who does not otherwise provide services on a regular and continuing basis.
4.  Professional legal services.
5.  A Michigan or federally chartered depository financial institution that provides financial-related services.  Note:  Financial Institution may not provide financing to a casino licensee under this exemption provision.

Complete a "Supplier License Exemption Application" and submit to the MGCB.

Do you provide more than $5000 worth of non-gaming related goods and services on a regular and continuous basis and the total dollar amount in any rolling 12-month period, is equal to or less than $300,000 with 1 casino, or equal to or less than $600,000 with 2 or more casinos?

Complete a "Non-Gaming Vendor Exemption Application" and submit to the MGCB.

Do you provide less than $5000 worth of non-gaming related goods or services in a 12-month rolling period?  Right arrow saying Yes  Resolution 2009-01 Automatically grants an exemption.  MGCB does not require the submission of an application.

Is this a One-Time Transaction with a casino licensee?  Right arrow saying Yes Casino Licensee is required to provide notice to the MGCB.

Are you a person or entity providing nongaming-related goods and services on a regular and continuous basis and total dollar amount, in any rolling 12-month period, is equal to or greater than $300,000 with 1 casino or equal to or greater than $600,000 with 2 or more casinos?  Right arrow saying Yes 

Complete a "Non-gaming Supplier License Application" and submit to the MGCB with all required disclosures.
