The Michigan Public Service Commission (MPSC) today said it is seeking public comments on the application process for utility mergers and acquisitions.
Public Act 286 of 2008 does not allow any jurisdictional regulated utility to acquire, control or merge with an individual, corporation, association, partnership, utility or any other legal private or public entity, or sell, assign, transfer or encumber assets without first applying to and receiving approval from the Commission. Section 6q(3) directs the MPSC to promulgate rules creating procedures for the application process and lists certain information that shall be required.
Comments may be e-mailed to mpscedockets@michigan.gov. Written comments should be mailed to the Executive Secretary, Michigan Public Service Commission, P.O. Box 30221, Lansing, MI 48909. All comments should reference Case No. U-15964, should be consistent with provisions of the Act, and must be received by 5 p.m. on June 12. All information submitted to the Commission in this matter will become public information, available on the Commission's Web site, and subject to disclosure.
