The Michigan Department of Community Health (MDCH) has immediately suspended the license to practice medicine of Carlos A. Marcano, M.D., based on his convictions in the 17th Judicial Circuit Court, Kent County, Michigan. Marcano failed to report his convictions to MDCH as required by the Public Health Code.
On Aug.12, 2008, Marcano, 59, was convicted of one felony count of criminal sexual conduct - first degree and one misdemeanor count of criminal sexual conduct - fourth degree. As a result, Marcano was sentenced to incarceration for a minimum period of eight years and one year, respectively, to be served concurrently, with credit for 13 days.
On Nov. 21, 2008, MDCH issued an order summarily suspending Marcano's license pursuant to the Public Health Code, which provides for the mandatory summary suspension of a health professional's license upon the conviction of a felony, a misdemeanor punishable by imprisonment for a maximum term of two years, or a controlled substance-related conviction. An administrative hearing will be scheduled to address the status of Marcano license to practice medicine.
