    Agricultural Pesticide Dealer License

    The Michigan Department of Agriculture and Rural Development administers licenses to all Agricultural Pesticide Dealers in Michigan. Any establishment at which agricultural pesticides are sold or offered for sale to the end user is required to obtain an Agricultural Pesticide Dealer License (unless they already have a restricted use pesticide dealer license). An agricultural pesticide is any pesticide with Worker Protection Labeling as required by 40 CFR Parts 156 and 170.

    Agricultural Pesticide Dealer License

    B. STATUTORY AUTHORITY:  

    Part 83, Pesticide Use Natural Resources and Environmental Protection Act, Public Act 451 of 1994.  

    C. APPLICABLE REGULATION:  

    No administrative rules

    D. SUMMARY OF PERMIT/APPROVAL PROCESS:  

     1.  Applicability (activities that require the permit)  

    Any establishment at which agricultural pesticides are sold or offered for sale to the end user is required to obtain an Agricultural Pesticide Dealer License unless they already have a restricted use pesticide dealer license.

     2.  Pre-Application Requirements  

    Out-of-State Agricultural Pesticide Dealers must retain the services of an in-state resident agent before they can obtain an agricultural pesticide dealer license.

    The resident agent may be an individual living in the state, whose business office or residence is identical with the registered office, a domestic corporation or limited liability company, or a foreign corporation or limited liability company authorized to transact business in the state and having a business office identical with the registered office. You must provide the name, address, and telephone number of the resident agent on the agricultural pesticide dealer license application. The resident agent acts as a primary point of contact for department communications with your business.

    In-state Agricultural Pesticide Dealers do not need a resident agent to apply for an agricultural pesticide dealer license.

     3.  Application Submission Requirements  

    Annual renewals must be submitted by December 31 of each year on a form provided by the MDARD and containing all the required information.

    Licensing fee of $100

     4.  Procedures and Time-Frame for Obtaining Permit or Approval  

    Applications for a new license must be submitted through the One Stop portal. Your application is sent to MDARD as soon as you pay for your shopping cart. Licenses are typically issued within one week.

     5.  Operational Requirements  

    Any establishment at which agricultural pesticides are sold or offered for sale to the end user is required to obtain an Agricultural Pesticide Dealer License unless they already licensed as a restricted use pesticide (RUP) dealer.

    Out of State Agricultural Pesticide Dealers must:

    Retain the services of an in-state resident agent before they can obtain an agricultural pesticide dealer license. Dealers must provide the name, address, and telephone number of the resident agent on the agricultural pesticide dealer license application. The resident agent acts as a primary point of contact for department communications with your business.

    Report to the agricultural pesticide registrant/manufacturer the following information related to the sale/distribution of agricultural pesticides. The product name, EPA registration number, amount of pesticide sold or distributed, wholesale value of the pesticide sold or distributed, date of sale or distribution, sales or distribution invoice number, and the name and address of the consignee.

    NOTE: OUT OF STATE LICENSED RESTRICTED USE PESTICIDE DEALERS DO NOT NEED TO OBTAIN A SEPARATE Agricultural Pesticide Dealer License, BUT MUST COMPLY WITH THE RESIDENT AGENT REQUIREMENT AND THE REPORTING REQUIREMENT AS FOLLOWS:

    Report to the agricultural pesticide registrant/manufacturer the following information related to the sale/distribution of agricultural pesticides: The product name, EPA registration number, amount of pesticide sold or distributed, wholesale value of the pesticide sold or distributed, date of sale or distribution, sales or distribution invoice number, and the name and address of the consignee.

    In-State Agricultural Pesticide Dealers:

    In-state agricultural Pesticide Dealers do not need a resident agent to apply for an agricultural pesticide dealer license, and do not need to report to the agricultural pesticide registrant/manufacturer the information related to the sale/distribution of agricultural pesticides.

    NOTE: IN-STATE LICENSED RESTRICTED USE PESTICIDE DEALERS DO NOT NEED TO OBTAIN A SEPARATE Agricultural Pesticide Dealer license, AND ARE NOT REQUIRED TO REPORT SALES OF AGRICULTURAL PESTICIDES:

    License Renewal:

    Agricultural Pesticide Dealer License must be renewed by the December 31st of each year.

     6.  Fees  

    $100.00 per annual license.  

     7.  Appeal Process  

    No formal appeal process is outlined in the governing statute. However, the right to a contested case hearing can be created when an agency seeks to modify or terminate a license or entitlement. MCL 24.201 et seq.  

     8.  Public Input Opportunities  

    Complaints related to the improper sales of restricted use pesticides can be made at any time to the Michigan Department of Agriculture and Rural Development, Pesticide and Plant Pest Management Division. The complaints are investigated and if they are validated through an inspection and if a violation is found during the inspection, these findings are considered in the decision-making process.
