    Aircraft Dealer License

    The Michigan Department of Transportation issues

    A. NAME OF PERMIT OR APPROVAL:

    B. STATUTORY AUTHORITY: 

    Aircraft Dealer Licenses are issued per paragraph 259.82 of the Aeronautics Code of the State of Michigan 

    C. APPLICABLE REGULATION: 

    Section 17 of the General Rules of the Michigan Aeronautics Commission 

    D. SUMMARY OF PERMIT/APPROVAL PROCESS: 

     1.  Applicability (activities that require the permit) 

    A person shall not engage in the business of buying, selling, brokering, or dealing in aircraft of a type required to be registered, unless he or she has received a license from the commission.

     2.  Pre-Application Requirements

     3.  Application Submission Requirements 

    A dealer must apply to the Bureau of Aeronautics and Freight Services for aircraft registration before transferring possession or control of an aircraft to a purchaser.

     4.  Procedures and Time-Frame for Obtaining Permit or Approval 

    New Dealers:
    Obtain a Michigan Aircraft Dealer license form, number 4021 The application package must contain:

    • a completed and signed form 4021, application for dealer license 
    • a copy of your Michigansales tax license, and
    • a check for $25 payable to the State of Michigan

    Existing Dealers - Renewals: 

    Renewal forms will be mailed out in November and must be returned on or before December 31. Complete the Michigan Aircraft Dealer license form, number 4021and mail along with:

    • a copy of your Michigansales tax license, and
    • a check for $25 payable to the State of Michigan

     5.  Operational Requirements 

    • A dealer or manufacturer shall display a dealer's license in a prominent location at his or her place of business.
    • A licensee shall maintain a record, to be open to inspection by any law enforcement officer or authorized officer or investigator of the commission, of every aircraft subject to registration which is bought, sold, exchanged, received, or accepted by the licensee for sale or exchange. A licensee shall submit a report to the commission of aircraft sold to a resident of another state and include the notice of sale or transfer and the registration certificate, if any.
    • The commission shall issue to aircraft manufacturers, aircraft engine manufacturers, and dealers a distinctive general registration number for each aircraft owned or controlled by them. These aircraft shall not be used except for demonstration, for sale, for ferrying, or for testing. General registration numbers for manufacturer and dealer aircraft shall be issued annually under the same conditions as registration certificates and a $5.00 charge made for the general registration numbers for manufacturer and dealer aircraft. The general registration number issued to a manufacturer or dealer shall be displayed in the aircraft at all times.
    • A manufacturer or dealer selling or exchanging aircraft subject to registration, before delivering an aircraft to the purchaser, shall apply to the commission for aircraft registration, and the purchaser shall sign the application for registration and other necessary papers to enable the manufacturer or dealer to apply to the commission.
    • A dealer dismantling or wrecking any registered aircraft shall forward the registration certificate for that aircraft to the commission within 15 days for cancellation.
    • The commission may cancel, revoke, or suspend the dealer's license for failure to comply with this section.
    • A dealer must apply to the Bureau of Aeronautics and Freight Services for aircraft registration before transferring possession or control of an aircraft to a purchaser. A purchaser shall sign the application for registration and any other necessary papers which enable the dealer or manufacturer to apply for the regular registration of the aircraft. An application shall be accompanied by the required fee, which is one cent per pound of gross weight. An application for registration must be submitted to the Bureau of Aeronautics within 15 days after the transfer of possession or control of an aircraft to a purchaser.
    • When a dealer transfers or sells a registered aircraft out of state, the TRANSFER portion of the Michiganaircraft registration certificate is to be completed and submitted to the Registrar. There is no transfer fee for out of state sales.
    • Dealers must keep a record of all aircraft bought, sold, exchanged, received, owned, controlled, or accepted by the dealer for sale or exchange.

     6.  Fees 

    Dealer License Fee: $25.00 per license per year (must be renewed yearly)


    Dealer Aircraft Registration Fee: 

    • When a dealer accepts, acquires, or assumes ownership, possession, or control of an aircraft that is subject to, but is not registered in this state, the dealer shall submit a completed application for dealer aircraft registration (Form 4004a) and a $5 dealer aircraft registration fee.
    • The dealer may elect to register the aircraft as a dealer aircraft or in accordance with the regular aircraft registration and fee requirements. Regular registration would allow the aircraft to be used for other purposes. An aircraft registered under the provisions of dealer aircraft registration shall be used only for sale demonstration, ferrying, or testing purposes incidental to sale. 

      7.  Appeal Process 

    In any case in which the department rejects an application for permission to operate an airport, landing field, or other aeronautical facility, or in any case where the department shall issue any order requiring certain things to be done, it shall set forth its reasons for the order and shall state the requirements to be met before approval will be given. In any case in which the department considers it necessary, the department may order the closing of any airport, landing field, or other aeronautical facility, until compliance is made with the requirements ordered by the department.

     8.  Public Input Opportunities
