Controlled Atmosphere Sealed Storage License

The Michigan Department of Agriculture and Rural Development administers licenses to all Controlled Atmosphere Storage Operators Licensing program is for any fruit or vegetable grower that wishes to market their product as meeting the qualifications of Act 228 of 1959 as revised to Act 53 of 2000, effective March 30, 2000, when the producer meets this act they can market their product as "CA STORAGE" produce.


A. NAME OF PERMIT OR APPROVAL: 

Controlled Atmosphere Sealed Storage Application (Form PI-209)and Room Closure Notification Card (PI-210) These forms are available on MDARD's website. 

B. STATUTORY AUTHORITY: 

FRUITS AND VEGETABLES; CONTROLLED ATMOSPHERE STORAGE, Act 228 of 1959

C. APPLICABLE REGULATION:

No administrative rules

D. SUMMARY OF PERMIT/APPROVAL PROCESS: 

 1.  Applicability

Any person that wishes to be certified to sell, label, describe, advertise, offer, expose, exchange, or transport fruits or vegetables for sale represented as having been held under "controlled atmosphere storage".


Please note that several states and foreign countries have quarantines, which require apples and other fruit to be held in a licensed and approved controlled atmosphere storage in order to qualify for phytosanitary certification.

 2.  Pre-Application Requirements 

Complete annually MDARD Controlled Atmosphere Sealed Storage Application(Form PI-209 & PI-210)


Mail completed application along will a fee of $35.00 per room before November 15 (rooms must be sealed on or before November 15).


Seals rooms, completes Room Closure Notification Card (PI-210)and mails to Grand Rapidsoffice requesting inspection.

 3.  Application Submission Requirements 

Complete application and submit by November 15 of each year.

Include fee of $35.00 per room for each room being licensed.

 4.  Procedures and Time-Frame for Obtaining Permit or Approval 

Completion of all forms on or before November 15, 2008. 

Rooms will be tested by inspector once the Room Closure Notification Card is received.

If they meet the requirements a license will be issued.

 5.  Operational Requirements 

Complete license application.

Seal Rooms. 

Within sealed room maintain for apples the following:

Oxygen:

  • 5% or lower 14 days after the storage room is sealed.
  • For a minimum period of 60 days, except that gala and jonagold varieties may be removed from storage in not less than 45 days.
  • May be more than 5% for an accumulated time not to exceed 10 days (240 hours). 
  • If the atmospheric conditions have been interrupted, the minimum storage period shall be increased to 70 days for all fruit except gala and jonagold, which shall have a minimum storage period of 55 days.

Temperature:

  • 35 degrees for jonathan, romebeauty, delicious, and stayman varieties. 
  • If interruptions in atmospheric conditions occur, the operator shall notify the department within 48 hours after the atmospheric conditions in the sealed storage room are interrupted.
  • Sealed storage rooms whose atmospheric conditions were interrupted may be resealed by an authorized representative of the department.
  • Submit Room Closure Notification Card within 5 days of sealing rooms.
 6.  Fees 

Mail completed application along will a fee of $35.00 per room before November 15 (rooms must be sealed on or before November 15)

  

 7.  Appeal Process 

No formal appeal process is outlined in the governing statue. However the statute provides for notice and opportunity for a hearing under the Administrative Procedures Act of 1969, 1969 PA 306, MCL 24.201 to 24.328.

  

 8.  Public Input Opportunities 

Any complaints should be directed to the Lansingoffice. A list of the Licensed Controlled Atmosphere Storage Operators can be found on MDA's website.
