    Tall Structures Permit

    The Michigan Department of Transportation issues


    A. NAME OF PERMIT OR APPROVAL:

    Michigan Tall Structure Permit

    B. STATUTORY AUTHORITY:

    Michigan Tall Structure Permits are issued under the authority of the Michigan Tall Structures Act.

    C. APPLICABLE REGULATION:

    No Administrative Rules

    D. SUMMARY OF PERMIT/APPROVAL PROCESS:

     1.  Applicability (activities that require the permit)

    Proposed construction or alteration of an existing structure that is in the vicinity of a public use airport as defined in MCL 259.482 and for all structures that are greater than 200' above ground level regardless of its proximity to an airport.

     2.  Pre-Application Requirements

    Concurrent application to the Federal Aviation Administration

     3.  Application Submission Requirements

    Please e-mail to Linn Smith at the Bureau of Aeronautics for an application. The application must be filled out in its entirety and signed by the sponsor or the sponsors representative.

     4.  Procedures and Time-Frame for Obtaining Permit or Approval

    Permits or denied applications are usually issued within 10 days from the time the FAA determination is received and finaled.

     5.  Operational Requirements

    No structure shall be constructed or altered as defined in MCL 259.482.

     6.  Fees

    A total project fee not to exceed $1000 for a group of applications for structures less than 100' above ground level within a 1 mile radius. The project fee would increase to $2,500 for structures exceeding 100' above ground level and within a mile radius.

     7.  Appeal Process

    Appeals may be requested to the Michigan Aeronautics Commission as outlined in MCL 259.489 .

     8.  Public Input Opportunities

    All applications received within five statute miles from a public use airport are sent to the Airport Manager.
