Entire Tribunal Prehearing General Call

In 2009, after receiving input from stakeholders, the Tribunal determined that the most efficient process for scheduling cases for a Prehearing was the Prehearing General Call. The Tribunal implemented this process in June, 2009, with the first Notice of Prehearing General Call being issued on June 15, 2009. Notice of Prehearing General Calls have been, and will continue to be, issued two times per month. Each Prehearing General Call will contain, for the time being, approximately 100 cases.

It is important to note that the Prehearing General Call provides the parties nine months in which to prepare and file their valuation disclosures and to serve them on the opposing party. The Tribunal believes that this time is more than sufficient, especially considering that parties should conduct discovery and begin preparing their valuation disclosures prior to being placed on the Prehearing General Call. For this reason, motions for extension of time will be granted only in the rarest of circumstances. Parties who do not comply with this deadline will likely not be permitted to introduce evidence in support of their value contentions at the hearing.

In addition, please note that the Prehearing General Call now includes deadlines by which each party shall notify the Tribunal and the opposing party if no valuation disclosure is required in that case and, if a valuation disclosure is required, the name of the valuation expert retained by that party. Pre-Valuation and Post-Valuation discovery deadlines are also included in the Prehearing General Call. Finally, the Prehearing General Call includes a deadline for filing Prehearing Statements.

It is the Tribunal’s intent, given the limited number of cases placed on each Prehearing General Call, to schedule each case for hearing shortly after the Prehearing Conference. Parties should be prepared to proceed accordingly.
