RE: Revised Listing of "Due
State of Michigan" Sub-Account Numbers
Attached is a revised listing of the "Due
State of Michigan" sub-account numbers for inserting into your copy of
the "Uniform Chart of Accounts for Counties and Local Units of Government
in Michigan," issued April 2002. The revisions to the "Due State of
Michigan" sub-account numbers are the result of major legislative changes
to the court funding process at the local level.
Public Acts (PA) 70-79, 95-102, and 138 of 2003
takes effect October 1, 2003; and amends the laws affecting filing fees, civil
infraction assessments, minimum costs for misdemeanor and felony convictions,
conditions of probation and parole, and priority of payment. Generally, these
laws increased revenue for various judiciary and criminal justice related
entities by increasing civil filing and motion fees; and consolidating the
assessments and state-level costs imposed on civil infractions and criminal
offenses, with a net increase in the revenue generated by such
assessments/costs. The process for distributing revenue generated by both filing
fees and assessments/costs was revised by moving the earmarking of revenue from
the local level to the state level.
This sub-account
becomes an OPEN account, effective October 1, 2003. The
Legislative Retirement (Share of Entry Fee) (MCL
600.2529, amended) was amended by PA 97 of 2003 and PA 138 of 2003.
The legislative retirement is now allocated (distributed) as part of the
Civil Filing Fee Fund and Justice System Fund
This sub-account
becomes an OPEN account. The Court Equity Fund (State cost) (MCL
600.8381, amended) is now allocated as part the Civil Filing Fee
Fund and Justice System Funds created under PA 97 and PA 138 of 2003,
effective October 1, 2003.

is now allocated as a percentage of the Justice System Funds created by
PA 97 of 2003, effective October 1, 2003.

82 of 1982) (MCL
257.907(13), amended) and 712A.2)
is now allocated as a percentage of the Justice System Funds created by
PA 97 of 2003, effective October 1, 2003. The $5.00 fee assessment is no
longer collected effective October 1, 2003.

becomes an OPEN account. The Secondary Road Patrol and Training
Fund (PA 163 of 1991) (MCL
257.629e, amended; and 712A.2)
is now allocated as part of the Justice System Fund created by PA 97 of
2003, effective October 1, 2003. The $10.00 fee is no longer collected.

becomes an OPEN account. The Forensic Lab Testing Fee (PA 35 of
1994) (MCL
12.206, amended) is no longer collected effective October 1, 2003.

is OPEN. The Jail Reimbursement Program Fund (Civil Infraction) (MCL
769.35) is now allocated as part of the Justice System Fund created
by PA 97 of 2003, effective October 1, 2003. The $5.00 fee is no longer
collected.
New
sub-account titled "Civil Filing Fee Fund" (MCL
600.171). PA 138 of 2003 requires this fund to be established by the
State Treasurer. Use this account to make all deposits to the State of
Michigan as defined in the statute and the revised fee schedule issued
by the State Court Administrator's Office.

sub-account titled "Justice System Fund" (MCL
600.181). PA 97 of 2003 requires this fund to be established by the
State Treasurer. Use this account to make all deposits to the State of
Michigan as defined in the statute and the revised fee schedule issued
by the State Court Administrator's Office.

New
sub-account titled "Attorney General Operations Fund (MCL
600.2538(3), amended). This fund is required by PA 138 of 2003 and
used to account for deposits to the fund from the Friend of the Court (FOC)
payments of support and maintenance fees. This amount represents 25
cents of the total $1.50 support payment collected by the FOC on each
case.
Please note that the use of the correct
sub-account number is important. The Michigan Department of Treasury, Receipts
Processing Division uses these account numbers for depositing these collections
into the applicable State funds and accounts.
