RE: Mileage Rate for Service of Process

The Michigan Department of Civil Service has established the premium mileage rate for approved private car use for State employees at 37.5 cents per mile effective January 1, 2004. This rate matches the Federal Standard Mileage Rate.

This is an increase from the current mileage rate, 36 cents per mile (effective January 1, 2003).

In accordance with the provisions of 1982 Public Act 173, [MCL 600.2559(4)] 37.5 cents per mile will be the statutory mileage rate for all court process served on and after January 1, 2004. The statute allows the mileage rate claimed to be 1.5 times the rate allowed for employees in the state classified civil service. Mileage is computed, each way, by the shortest distance from the court that issued or filed the process or paper to the place of service, not to exceed 75 miles each way.

We request that the county clerk advise the county sheriff and all court administrators of the new mileage rate within their county.
