2005-5. This
Numbered Letter announces the change in the statutory mileage rate allowed for
the process or paper served out of a court by an authorized person. This
Numbered Letter supersedes 2005-4.
The Michigan Department of Civil Service has
established the premium mileage rate for approved private car use for State
employees at 48.5 cents per mile for the period beginning September 1, 2005 and
ending December 31, 2005. After December 31, 2005, the Civil Service will
re-evaluate the mileage rate. The previous mileage rate (effective January 1,
2005 through August 31, 2005) was 37.5 cents per mile. Any questions concerning
the mileage rate should be directed to the Michigan Department of Civil Service
at (517) 373-3048.
In accordance with the provisions of Public
Act 173 of 1982, MCL 600.2559(4), the statutory mileage rate that an authorized
person is entitled to receive for all court process or papers served on and
after September 1, 2005 is 1.5 times the rate allowed for employees in the State
classified civil service or 72.75 cents per mile (48.5 x 1.5). Mileage is
computed, each way, by the shortest distance from the court that issued the
process or paper to the place of service, not to exceed 75 miles each way.
