Recent testing of the 2010 rate calculation program disclosed a limited problem with the published rate tables for 2009 and 2010 in those situations where the prior benefit standard of 2/3 of the average weekly wage applies rather than 80% of the after-tax average weekly wage. Those rates are normally identified by an asterisk next to the 80% amount. Although the calculation program has always been correct, we have determined that the asterisks were not displaying properly in the rate tables. For 2009, this applies to AWW's from $215 through $271, and for 2010, to AWW's from $224 through $277 with zero dependents and a tax filing status of single or married/separate.

have been posted. If you previously printed a hard copy for your reference, please reprint rate book pages 22-28 for 2009 and 23-28 for 2010.
Please note that if indemnity benefits were previously paid on claims involving the above criteria and a Form 701 was submitted, a letter would have been issued from us indicating that an incorrect rate was being paid.
