COMMUNITY RIGHT-TO-KNOW COMMISSION

MICHIGAN DEPARTMENT OF NATURAL RESOURCES

MICHIGAN DEPARTMENT OF ENVIRONMENTAL QUALITY


 

EXECUTIVE REORGANIZATION

 

WHEREAS, Executive Order 1994-17 established the Michigan Emergency Planning and Community Right-to-Know Commission ("Commission") in order to fulfill the duties prescribed for a state emergency response commission in section 301(a) of the Superfund Amendments and Reauthorization Act of 1986 ("Act"), which include coordinating the response of state and local governments to hazardous material emergencies; and

 

WHEREAS, because prior to October 1, 1995, the Michigan Department of Natural Resources' Environmental Assistance and Environmental Response Divisions had compliance responsibility for the Title III requirements of the Act, and were otherwise the Divisions within the Department with technical expertise regarding hazardous materials and their effect on the environment, the Director of the Michigan Department of Natural Resources or his/her designee was appointed as a member and vice-chair of the Commission; and

 

WHEREAS, Executive Order 1995-18 transferred, as of October 1, 1995, the Environmental Assistance and Environmental Response Divisions from the Michigan Department of Natural Resources to the Michigan Department of Environmental Quality; and

 

WHEREAS, the transfers effectuated by Executive Order 1995-18 established the Michigan Department of Environmental Quality as the state department responsible for hazardous material issues, including compliance with Title III of the Act and their effect on the environment; and

 

WHEREAS, in order to ensure that the Commission membership continues to consist of those Departments which play a role in hazardous material emergency planning and response, it is necessary to appoint the Director of the Michigan Department of Environmental Quality as a member and vice-chair of the Commission in the place of the Director of the Michigan Department of Natural Resources.

 

NOW, THEREFORE, I, John Engler, Governor of the State of Michigan, pursuant to the powers vested in me by the Constitution of the State of Michigan of 1963 and the laws of the State of Michigan, do hereby order the following:

1. The Director of the Michigan Department of Environmental Quality, or his/her designee, shall serve as a member and vice-chair of the Commission, in the place of the Director of the Michigan Department of Natural Resources.

2. The Michigan Department of Environmental Quality shall maintain and process all reports required under the Act.

3. The Director of the Michigan Department of Natural Resources shall no longer serve as a member or vice-chair of the Commission.

 

The provisions of this Executive Order shall become effective upon filing.
