    The Environmental Rules Review Committee (ERRC) was created by Public Act 267 of 2018, the ERRC was created to oversee all rulemaking of the Michigan Department of Environment, Great Lakes, and Energy. The ERRC is comprised of four ex-officio department heads and 12 members, appointed by the governor, who represent different industries and organizations outlined in statute.

    PFAS RULEMAKING

    On Thursday, February 27, 2020, the ERRC approved the draft proposed Supplying Water to the Public rules which limit PFAS contamination in drinking water.

    The draft “PFAS” rules and supporting documents are being forwarded to the Michigan Office of Administrative Hearings and Rules and will then move on to the Joint Committee on Administrative Rules (JCAR), the final step in the rulemaking process.

    HAZARDOUS WASTE MANAGEMENT RULEMAKING

    Updates to the Hazardous Waste Management rules are also in the final stage of rulemaking. This rule set (2018-12 EQ) did not go through the oversight of the ERRC because the rulemaking started prior to the creation of the ERRC. The JCAR Package which includes the draft rules, public hearing transcript, written comments received during the public comment period, and the JCAR report were submitted to MOAHR on January 31, 2020.

    NEXT MEETING

    No new meetings have been scheduled. It is expected the ERRC will be meeting late summer when new rulemaking is proposed.
