Environmental Rules Review Committee

  • Public Act 267 of 2018 created the Environmental Rules Review Committee (ERRC) to oversee the rulemaking of the Michigan Department of Environment, Great Lakes, and Energy. The ERRC is comprised of four ex-officio department heads and 12 members, appointed by the governor, who represent different industries and organizations outlined in statute.

    PFAS RULEMAKING

    The PFAS rules were filed with the Office of the Great Seal and effective August 3, 2020. 

    The official PFAS rules and other supporting documents are published on the Michigan Office of Administrative Hearings and Rules’ Web site at Michigan.gov/MOAHR. Select “Administrative Rules”, “Pending Rules Activity,” and then “Rules Currently Pending in the Rulemaking Process.” Sort by Rule Set #, scroll to Rule Set # 2019-35 EG, and select it.  

    HAZARDOUS WASTE MANAGEMENT RULEMAKING

    The Hazardous Waste Management rules were filed with the Office of the Great Seal and effective August 3, 2020.

    This rule set (2018-12 EQ) did not go through the oversight of the ERRC because the rulemaking started prior to the creation of the ERRC.

    The official Hazardous Waste Management rules and supporting documents are published on the Michigan Office of Administrative Hearings and Rules’ Web site at Michigan.gov/MOAHR. Select “Administrative Rules”, “Pending Rules Activity,” and then “Rules Currently Pending in the Rulemaking Process.” Sort by Rule Set #, scroll to Rule Set # 2018-12 EQ and select it.  Access Rule Set # 2018-12 EQ directly.

    NEXT MEETING

    The ERRC meeting scheduled for Thursday, September 24, 2020 has been canceled. The next ERRC meeting is scheduled for Thursday, October 22, 2020.
