Natural Resource Damage Assessment

Federal and state statutes authorize federal, state, and tribal governments to seek compensation on behalf of the public for natural resources injured or destroyed when property becomes contaminated with petroleum. The Memorandum of Understanding (MOU) establishes the Trustee Council, whose members are responsible for assessing the damages to natural resources resulting from the discharge of oil into Talmadge Creek and the Kalamazoo River and applying any damages recovered toward the restoration, rehabilitation, replacement, or acquisition of equivalent natural resources. The MOU is intended to ensure coordination of Trustee activities with the "Response" actions currently led by U.S. EPA and transitioning to EGLE to minimize continuing and residual injury and to achieve or enhance restoration of injured natural resources.
