New Hazardous Waste Rules Effective August 3, 2020

On July 27, 2020, amendments to the rules promulgated under Part 111, Hazardous Waste Management, of Michigan's Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (Part 111), were filed with the Michigan Department of State, Office of the Great Seal. The rules become effective on August 3, 2020.

These revisions address the following subject areas:

The GIR significantly restructured the generator rules to make it easier to determine the requirements that apply to each type of generator and include provisions for episodic events and large quantity generator consolidation of certain wastes.

Rule Availability

The new rule revisions can be downloaded from the Michigan Office of Administrative Hearings and Rules' (MOAHR) Administrative Rulemaking System. In addition to the consolidated rules, EGLE also has a rules cover sheet and table of contents, and color strike/bold format version of the rule revisions available. To obtain these documents electronically go to Michigan.gov/EGLEWaste, select "the Hazardous Waste" tab on the left, select "Hazardous Waste and Liquid Industrial By-Products Management" in the middle," and scroll down to select "Statutes and Rules."  Hard copies of the documents may be obtained by sending a written request and pre-addressed, 12-inch by 15-inch envelope capable of holding 300 pages to the address below.  Mailing response times may be delayed due to staffing changes resulting from the pandemic.
