Paid Medical Leave Act Takes Effect March 29, 2019

March 26, 2019 – On March 29, 2019, Public Act 338 of 2018, as amended, or the Paid Medical Leave Act (PMLA), will take effect. A copy of the act and related resources, including the required poster and FAQs, may be obtained by visiting here.

PMLA applies to employers with 50 or more individuals regardless of full or part-time status. All employees of a business who work in the United States, or any territory or possession of the United States, are included to determine if an employer is subject to the PMLA.

Specifics of the PMLA include:

  • An eligible, nonexempt employee is an individual engaged in service to an employer in the business of the employer and from whom an employer is required to withhold for federal income tax purposes. An eligible employee’s primary work location must be in Michigan.
     
  • The PMLA has 12 specific employee exemptions, most notably individuals under 18 years of age, employees who worked less than 25 hours per week on average in the preceding calendar year, and most overtime exempt employees. A full list of employee exemptions is available here.
     
  • Paid medical leave is accrued at a rate of 1 hour for every 35 actual hours worked; however, an employer is not required to allow accrual of over 1 hour in a calendar week or more than 40 hours in a benefit year. Accrual for paid medical leave begins on March 29, 2019, or upon commencement of the employee’s employment, whichever is later. As an alternative, an employer may provide at least 40 hours of paid medical leave to an eligible employee at the beginning of a benefit year.
     
  • Paid medical leave must be used in 1-hour increments unless the employer has a different increment policy set forth in writing in an employee handbook or other employee benefit document.
