Section 18 Labels
Section 18 of FIFRA, the federal law which regulates pesticides, authorizes the Environmental Protection Agency (EPA) to exempt the Michigan Department of Agriculture and Rural Development (MDARD) from federal registration requirements if it is determined "emergency" conditions exist which require an exemption. An emergency condition is an urgent, non-routine situation resulting in dire consequences if the exemption is not granted.
Section 18 exemptions primarily allow the use of a pesticide on a site for which it is not federally registered. MSU Extension specialists or industry groups inform MDARD when such an emergency situation exists. They then work with MDARD to prepare a Section 18 exemption application for submission to EPA. Section 18 exemptions are valid for a single growing season and are specific to the state that requested the exemption.
