Notice of Public Hearing: Special Education Programs and Services Rule Set 2023-76 ED

The Michigan Department of Education (MDE) Office of Special Education (OSE) will hold public hearings to receive public comments on proposed changes to the Special Education Programs and Services rule set.

R 340.1721b, R 340.1723c, and R 340.1733 are proposed to be amended. The general purpose of the proposed R 340.1721b is to align the rule with the requirements of the Individuals with Disabilities Education Act (IDEA), 42 US 1400 to 1482, regarding students who are parentally-placed in nonpublic schools. The general purpose of the proposed R 340.1723c is to remove the requirement that a parent's request for an independent educational evaluation of their child be in writing. The general purpose of the proposed R 340.1733 is to revise the age span of preschool programs located in elementary school buildings.

The public hearings will be conducted in compliance with the 1990 Americans with Disabilities Act. All public hearings will include an American Sign Language interpreter. Virtual hearings will include both an interpreter and closed captioning. The Michigan Library & Historical Center is accessible with handicap parking available. Written comments about the proposed rules must be received by the MDE no later than 5:00 p.m. on April 19, 2024. The MDE OSE will review and consider all timely written comments. Written comments may be submitted in the following ways:
