On or about 12/26/2024 the Michigan State Housing Development Authority (MSHDA), Oakland County, and City of Pontiac will submit a request to the U.S. Department of Housing and Urban Development (HUD) for (1) the release of MSHDA Project Based Voucher (PBV) funds, (2) the release of Pontiac Housing Commission/City of Pontiac PBV funds under Section 8 (o)(13) of the U.S. Housing Act of 1937 (42 U.S.C. 1437f(o)(13)) and (3) Oakland County Community Development Block Grant (CDBG) Funds under Title 1 of the Housing and Community Development Act of 1974, Public Law 93-383 (42 U.S.C. 5301 et seq) as amended, to undertake the project known as Beacon Place, for the purpose of:

MSHDA, Oakland County and City of Pontiac intends to award Beacon Place Limited Dividend Housing Association LLC. up to (1) 24 units of MSHDA Project Based Voucher (PBV) rental assistance, (2) 8 Units Pontiac Housing Commission PBV rental assistance and (3) $2,000,000 of Oakland County CDBG funds in support of Beacon Place. Beacon Place is located at 101 Mechanic Street and 180 J Hubbard Lane, Pontiac MI. This is a renovation project across a 40-unit development. The units consist of 25 1-bedroom, 3 2-bedroom, and 12 3-bedroom units. Renovations include installation of a new roof, ventilation repairs, amenity upgrades and unit improvements. These include kitchen repairs and upgrades, living space renovation and bathroom rehabilitation.

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at MSHDA offices at 735 E. Public Comments
Any individual, group, or agency may submit written comments on the ERR to MSHDA, Oakland County, or City of Pontiac at the addresses written above. All comments received by 12/23/2024 will be considered by MSHDA and Oakland County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

Release of Funds (Vouchers)
MSHDA, Oakland County and City of Pontiac certify to HUD that Anthony Lentych in his capacity as MSHDA’s Chief Housing Investment Officer, David Coulter in his capacity as Oakland County Executive, and Tim Greimel in his capacity as Pontiac Mayor consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Beacon Place Limited Dividend Housing Association LLC. to use Program funds.

Objections to Release of Funds
HUD will consider objections to its release of funds and MSHDA, Oakland County and City of Pontiac certification received by 01/10/2024 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are one of the following bases: (a) the certification was not executed by MSHDA’s, Oakland County’s, or City of Pontiac’s Certifying Officer; (b) MSHDA, Oakland County, or City of Pontiac has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec 58.76) and shall be addressed to Michelle King, PIH Representative, or Keith E. Hernandez, Director, Community Planning and Development or DetroitCPD@hud.gov, Detroit Field Office, U.S. Department of Housing and Urban Development at 477 Michigan Avenue 16th Floor, Detroit Michigan 48226.  Objections can also be submitted via email at Environmental-PublicComments@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
