Department of State takes action against unregistered repair shops in Kent, Mecosta counties

The Michigan Department of State has issued temporary cease and desist orders against two repair shops in Kent and Mecosta counties for operating unregistered repair facilities.

NL Repair & Performance LLC, 5246 S. Division Ave. in Grand Rapids, owned by Manuel Sanabria-Galarza, was determined to be unregistered when a Secretary of State regulation agent conducted an inspection at the facility Jan. 18. The owner was given instructions on how to submit an application and become compliant. When he hadn’t done so, a cease and desist order was served Feb. 2.

Welling’s Garage, 155 N. Sheridan Road in Remus, owned by Richard Welling, was determined to be unregistered when a regulation agent conducted an inspection at the facility Jan. 16. The owner didn’t submit an application for a license to become compliant after receiving instructions. Therefore, a temporary cease and desist order was issued Feb. 6.

Temporary cease and desist orders prohibit the owners or anyone else at the two facilities from performing any further automotive repairs until the facilities comply with state law. Under state law, any person who knowingly provides automotive repair services without a registration or certificate is guilty of a misdemeanor, punishable by up to 90 days in jail or a fine of up to $1,000, or both.

Consumers who have a complaint against NL Repair & Performance or Welling’s Garage are encouraged to call the Office of Investigative Services automotive complaint line at 517-335-1410. Under Michigan law, a customer is entitled, by filing a civil action, to recover any amount paid to an unregistered facility for the repair of a motor vehicle belonging to that customer.

Consumers can verify whether the repair shop they are using is registered with the state using the Secretary of State’s online search tool by going to ExpressSOS.com, clicking on “Business Services” and then “Repair Facility Services.”
